Mississippi Traffic Accidents on Rail and Road
The Biloxi Police Department is left to clean up the mess after a car accident involving a train at a local intersection recently (include the date and not just “recently”). The accident happened when a Mercedes reportedly tried to beat the train. Luckily there were no injuries when the train clipped the car. Community members are concerned, however, about the underlying issue.
The crossing involved in the accident is one of several across the city with no warning lights or crossing guards to block traffic. Witnesses also claim that they were unable to hear the train’s horn. Residents are worried that, without change, this intersection and others like it will continue to endanger their lives and the lives of those they love.
Intersection Safety Agencies
The National Transportation Safety Board (NTSB) was established in 1967 to investigate civil aviation accidents and major accidents in other modes of transportation. This board is not part of the Department of Transportation and has no regulatory or enforcement powers. Organizations, such as the NTSB, are commissioned with identifying potential dangers and issuing safety recommendations.
Under the US Department of Transportation is the Federal Railroad Administration. This administration’s Office of Railroad Safety promotes and regulates safety in the railroad industry. According to the FRA, “federal law requires that, as a minimum, each state shall provide signs at all crossings. The railroad crossbuck sign and other supplemental signs attached to the crossbuck mast are usually installed and maintained by the railroad company. The agency responsible for maintenance of the roadway is normally responsible for advance warning signs and pavement markings.”
Staying Safe at Intersections
While safety regulations and traffic signals are in place to protect those on the road, it is important to always be cautious. This is especially true when larger modes of transportation, such as trains, are involved. Protect yourself and your family by being alert at intersections, especially potentially dangerous intersections. Intersections without lights and guard-systems in place can be particularly dangerous because people rely on the safety measures in place without stopping to look for themselves. Always take extra precautions and look both ways before crossing a train intersection.
In accidents involving major modes of transportation, such as trains, liability can be difficult to determine. The train engineer or operator, the company that owns the track, the train designer, local agencies, and the train operating company may all be partially liable for the accident. Factors to consider when examining liability in train accidents may include:
- Proper training of the train crew;
- Proper maintenance of the train and track;
- Ensuring that motorists have a clear line of sight at the crossing;
- Advanced warnings of oncoming trains; and
- The speed of the train.
