Yacht Club Horror Leads To Lifetime Disability
A young Gulfport sailor was seriously injured recently in an accident at the yacht club. The 20-year-old man was parking his sailboat at the Gulfport Yacht Club after taking his family on an afternoon sail when a cable from the mast of his boat touched an overhead power line. The man survived the incident but suffered second and third degree burns over much of his body and has had to have a third amputation due to the damage.
Who Is Responsible?
This incident is causing outrage in the community. People are calling for an investigation as to the circumstances surrounding the horrifying accident. One witness reportedly asked why overhead power lines are in an area where tall watercrafts and sailboats are regularly maneuvered and parked.
As with all premises liability cases, the law holds property owners legally responsible for injuries caused by unsafe conditions on an owner’s property. The placement of the overhead power lines could be a potential liability if the yacht club owners were aware of and ignored the dangers that the lines posed to boat owners. Currently, Mississippi Power is investigating the incident along with the placement of the lines in the area.
Premises liability claims occur when unsafe conditions on a property cause injury or death. When these conditions are deemed to present unreasonable danger, those injured may be due compensation. The most successful premises liability claims are won by proving one of the following:
- A dangerous condition that led to the accident was created by the property owner
- The dangerous condition was known by the property owner and they did nothing to rectify the situation
- The dangerous condition should have been known by the property owner
Survivors of serious accidents face years of future medical costs. Many injuries, such as internal bleeding, nerve damage, and brain injuries, may not immediately present at the time of the accident and only manifest themselves at a later time. Rehabilitation from a traumatic life altering event can take years, or even a lifetime.
Those seeking compensation in personal injury cases may be able to receive compensation for not only immediate medical needs, but also for long-term medical costs.
